Warranty

Game Star ("GAMESTAR") expressly disclaims any warranty for the SOFTWARE. The SOFTWARE is provided "AS IS" without warranty of any kind, either express or implied, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose or non-infringement. The entire risk arising out of the use or performance of the SOFTWARE remains with you. Because some states do not allow the exclusion of implied warranties, the above exclusion may not apply to you. In that event, any implied warranties are limited in duration to ninety (90) days from the date of delivery of the SOFTWARE. REGARDLESS OF WHETHER ANY REMEDY SET FORTH HEREIN FAILS OF ITS ESSENTIAL PURPOSE, IN NO EVENT WILL GAMESTAR BE LIABLE FOR ANY SPECIAL, CONSEQUENTIAL, INDIRECT OR SIMILAR DAMAGES, INCLUDING ANY LOST PROFITS OR LOST DATA ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE OR ANY DATA SUPPLIED THEREWITH EVEN IF GAMESTAR OR ANYONE ELSE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO CASE SHALL GAMESTAR'S LIABILITY EXCEED THE LICENSE FEE FOR THE SOFTWARE. BECAUSE SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. 

Return Policies.

Downloaded digital product is not eligible for return or refund. 

For software distributed on physical media (i.e. CD-ROM), GAMESTAR warrants to the original purchaser that the media will be free from defects in materials and workmanship for a period of thirty (30) days from the date of shipment. In the event of discovery of defective media during the warranty period, GAMESTAR shall replace the defective media. 

For web cameras, GAMESTAR warrants to the original purchaser that the product will be free from defects in materials and workmanship for a period of one (1) year from the date of shipment. In the event of discovery of a defective web camera during the warranty period, GAMESTAR shall, at its option, repair or replace the defective web camera. 

This is your sole remedy in the event of a warranty claim. This warranty does not apply to defects resulting from accident, abuse, misuse, mishandling, failure to provide a suitable operating environment, problems with electrical power, servicing not authorized by GAMESTAR, usage not in accordance with official product instructions or any other external causes. During this warranty period, GAMESTAR will repair or replace products returned to its facility, as determined by GAMESTAR in its sole discretion. Spare parts may be new or reconditioned. If GAMESTAR repairs or replaces a product, the warranty term is not extended. GAMESTAR owns all parts removed from repaired products. To request warranty service, you must contact GAMESTAR technical support within the warranty period by emailing support@gamestarinc.com. THIS LIMITED WARRANTY IS NOT TRANSFERABLE. 

For all returns, you will be issued a Return Material Authorization ("RMA") number by GAMESTAR. Within seven (7) days after you receive the RMA number. you must ship the product back to GAMESTAR (or any third party designated by GAMESTAR) in its original (or equivalent) packaging, prepay all shipping charges, and insure the shipment against risk of loss or damage and otherwise follow the instructions provided by GAMESTAR. If you fail to insure the Product, you accept the risk of loss or damage during shipment. GAMESTAR will return ship the repaired or replacement products to you, freight prepaid within the United States.

30-day Money Back Guarantee 

Exclusive of digitally downloaded software, GAMESTAR provides a limited thirty (30) day money back guarantee. During this period, you will be issued a full refund (less cost of shipping and handling) for sealed and unopened CD-ROMS and web cameras returned in new, saleable condition, together with all original software, packaging, materials and components, provided that you have requested a refund within such time. To receive a refund under this limited money back guarantee, you must contact a service representative at service@gamestarinc.com to return the product within thirty (30) days from the date when you received your product and follow the return procedures set forth herein. SHIPPING AND HANDLING ARE NOT REFUNDABLE. YOUR REFUND MAY BE DELAYED IF YOU DO NOT FOLLOW THESE INSTRUCTIONS AND ANY ADDITIONAL INSTRUCTIONS PROVIDED BY GAMESTAR. THIS LIMITED MONEY BACK GUARANTEE IS NOT A WARRANTY. GAMESTAR MAY CHANGE OR CANCEL IT AT ANY TIME BEFORE ACCEPTING YOUR ORDER.
